Many new clients that come into our Cape Cod or Stoughton offices think they only have two alternatives when they have been injured in a car accident; settlement or a trial. That is true. However, many clients do not know that mediation, and arbitration, are increasingly available options used to resolve personal injury cases of all kinds. 

In mediation, the parties meet with an agreed upon mediator; often a retired judge or trial lawyer, who helps them arrive at a reasonable settlement. In arbitration, the parties actually have a mini trial of sorts, and allow the arbitrator to come to a decision which is "binding" upon the parties. Both options avoid the expense and uncertainty of a trial and the cases are also resolved much faster than if they were to proceed to trial. Lately, even some complex medical malpractice cases are being resolved in this fashion.

In our office, I previously served as a mediator in our trial courts for over 8 years on a volunteer type basis and have been involved in hundreds of mediations. We are extremely experienced in resolving cases for our clients in this fashion. Of course, when a trial is necessary, with 26 years of trial experience, I am are always willing and ready to fight for my clients.
