How often lately do you read something about an individual causing a horrible accident with a cell phone being found as a possible cause for the accident.

Well, it certainly occurs much too often. However, lawyers now routinely request, as part of their case discovery, the production of all bills and records relating to cell phones, or other such devices that are in the vehicle of an at fault driver. These include MP3 players, PDAs and video players. All could have distracted a driver if they were in use.
If you are a driver or an occupant of a vehicle in an accident, and are physically able, help your attorney- to- be by trying to see if the at fault driver mentions, or was in posession of such devices. It could go a long way towards convincing an insurance adjuster or jury that the at fault operator wasn't paying attention to the road.
